There are many variables in this scenario so it is important to have a confidential conversation with your Property Manager before you decide to place the property on the market. Remember we are working for you, the landlord, so don't be afraid to ask questions or be worried the tenant will find out. Yes, we are legally obligated to advise them once a decision has been made, but before that stage we would rather you ask the quesion and make an informed decision.
The period of notice can vary depending on whether or not your tenant is in a fixed term lease, whether you would like the property vacant before marketing for sale, whether you would like to leave the tenant in place during the sales process and sell with vacant possession, or whether you would like to sell the property as an investment with the tenant on a fixed term. The status of your lease will determine the answer to this question. Notice periods can vary from 30 - 90 days on a continuous lease and if the tenant is on a fixed term you will have to wait for the term to expire before vacant possession is legally granted.
Also remember that your sales agent is required to give the tenant 14 days written notice of the property going on the market before they are allowed to show it to prospective purchasers.
